End User License Agreement (EULA)
for ctYOU.org
Operated by the Oklahoma Department of Career and Technology Education (ODCTE)
I. Introduction
This End User License Agreement ("Agreement") constitutes a legally binding contract between you ("User," "you," or "your") and the Oklahoma Department of Career and Technology Education ("ODCTE," "we," "us," or "our") governing your access to and use of ctYOU.org ("the Site").
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, you are prohibited from accessing or using the Site.
II. Definitions
For purposes of this Agreement, the following terms shall have the meanings set forth below:
- "Agreement" means this End User License Agreement governing the use of ctYOU.org.
- "User," "you," or "your" means any individual accessing or using the Site, whether as a student, instructor, or content creator.
- "ODCTE," "we," "us," or "our" means the Oklahoma Department of Career and Technology Education, the owner and operator of ctYOU.org.
- "Site" means the ctYOU.org website and any associated services, systems, and content offered through the website.
- "Content" means all curriculum, educational materials, documents, videos, graphics, text, and other materials made available on or through the Site.
- "Open LMS" means the third-party hosting and technical support provider for the Site, available at https://www.openlms.net/.
- "Third-Party Applications" or "Moodle Plugins" means software, services, or tools created by entities other than ODCTE that may be integrated into or used in connection with the Site. ODCTE does not control and is not responsible for Third-Party Applications or Moodle Plugins.
III. Ownership of Content
All curriculum, content, and materials available on the Site are the property of ODCTE unless otherwise specifically stated. Certain content may be provided by third-party users who retain ownership of their respective works.
You may not copy, reproduce, distribute, display, or otherwise use any content from the Site outside of ctYOU.org without obtaining prior written authorization from ODCTE or the rightful third-party content owner.
Unauthorized use of materials may result in legal action.
IV. Grant of License
Subject to compliance with this Agreement, ODCTE hereby grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for educational purposes.
ODCTE reserves the right, at its sole discretion, to suspend, revoke, or terminate your access to the Site at any time and for any reason deemed appropriate.
V. Prohibited Conduct
You agree not to engage in any of the following activities while using ctYOU.org:
- Bullying, harassment, or intimidation of any individual or group.
- Use of hate speech, inflammatory speech, or promotion of violence.
- Sexual harassment or use of sexually explicit, obscene, or pornographic materials.
- Uploading, posting, transmitting, or distributing any unlawful, violent, defamatory, or otherwise objectionable content.
- Violating any applicable local, state, or federal laws or regulations.
Engaging in any prohibited conduct will result in immediate suspension or termination of your account and may subject you to civil and criminal penalties under applicable law.
ODCTE reserves the right to pursue all available legal remedies for any violation of this Agreement.
VI. Account Termination and Suspension
ODCTE retains the absolute right to suspend or terminate your access to the Site, without prior notice, for any violation of this Agreement or for any other conduct that ODCTE, in its sole discretion, deems harmful to the Site, other users, or ODCTE’s interests.
Termination of access shall not limit ODCTE’s other legal rights or remedies available under applicable law.
VII. Maintenance, Upgrades, and Technical Support
ODCTE, through its service provider Open LMS, is responsible for maintaining the server infrastructure, storage, and physical hardware supporting ctYOU.org. Further information regarding Open LMS can be found at https://www.openlms.net/.
System upgrades to the Moodle platform, if available, are generally scheduled twice annually, typically during the months of June and December. However, the availability and timing of such upgrades are subject to change based on the release schedule of Moodle or other circumstances. In the event an upgrade is rescheduled or otherwise unavailable, ODCTE will provide prior notification to users when possible.

Technical support services will not be available during evenings, weekends, or State of Oklahoma recognized holidays.
VIII. Privacy and Protection of Student Data
ODCTE is committed to protecting the privacy and security of user information. Personal data collected through ctYOU.org will be handled in accordance with ODCTE’s Privacy Policies and the Family Educational Rights and Privacy Act (FERPA).
By using the Site, you consent to the collection, use, and disclosure of your information as described in those policies.
IX. Intellectual Property Rights
All intellectual property rights in and to the Site and its content, including but not limited to text, graphics, logos, curriculum, and other educational materials, are owned by ODCTE or its licensors, unless otherwise expressly identified.
Third-party users who create and upload original content to the Site retain ownership of their own work but grant ODCTE a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute their content within ctYOU.org for educational purposes.
X. Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to notify ODCTE immediately of any unauthorized use of your account.
ODCTE shall not be liable for any loss or damage arising from your failure to protect your login information.
XI. Third-Party Content, Applications, and Links
The Site may contain links to third-party websites, services, Moodle plugins, or other applications not owned or controlled by ODCTE.
ODCTE does not endorse, control, or assume any responsibility for any third-party content, applications, plugins, or services. You access such third-party materials at your own risk.
XII. Disclaimer of Warranties
The Site and all content, materials, and services provided therein are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied.
ODCTE expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service.
ODCTE does not guarantee that access to the Site will be continuous, error-free, secure, or free from viruses or other harmful components.
XIII. Limitation of Liability
To the fullest extent permitted by applicable law, ODCTE shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of or inability to use the Site.
This limitation applies even if ODCTE has been advised of the possibility of such damages.
XIV. Indemnification
You agree to indemnify, defend, and hold harmless ODCTE, its officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from your violation of this Agreement or your misuse of the Site.
XV. Force Majeure
ODCTE shall not be held responsible for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, governmental actions, war, terrorism, labor disputes, or failures of third-party suppliers or communications systems.
XVI. Severability
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
XVII. No Waiver
ODCTE’s failure to enforce any provision of this Agreement shall not be deemed a waiver of its right to enforce such provision at any later time.
XVIII. Entire Agreement
This Agreement constitutes the entire agreement between you and ODCTE concerning your access to and use of the Site and supersedes all prior or contemporaneous understandings, communications, or agreements, whether oral or written.
XIX. Amendments to the Agreement
ODCTE reserves the right to modify, amend, or replace this Agreement at any time. Changes will be effective immediately upon posting to ctYOU.org.
Your continued use of the Site after any changes are posted constitutes your acceptance of the modified Agreement.
XX. Governing Law and Jurisdiction
This Agreement shall be governed by, construed, and enforced in accordance with the laws of the STATE OF OKLAHOMA, without regard to its conflict of law principles.
Any legal actions or proceedings arising out of or relating to this Agreement shall be instituted exclusively in the courts located in the STATE OF OKLAHOMA.
XXI. Accessibility Compliance
ODCTE is committed to ensuring that ctYOU.org and all educational content provided through the Site are accessible to individuals with disabilities, in accordance with the requirements of Title II of the Americans with Disabilities Act (ADA) and the Web Content Accessibility Guidelines (WCAG) version 2.1, Level AA.
All users who upload, create, or contribute curriculum, materials, documents, media, or other content to ctYOU.org are required to ensure that their contributions meet the WCAG 2.1 AA accessibility standards.
By uploading or contributing content, you affirm that you have taken reasonable steps to ensure that your content is accessible to individuals with disabilities.
ODCTE reserves the right to review, modify, or remove any content that does not meet accessibility standards, and may require contributors to revise or update materials to bring them into compliance.
XXII. Changes to Services
ODCTE reserves the right to modify, suspend, or discontinue, temporarily or permanently, any part of ctYOU.org or the services provided through the Site, with or without notice.
You agree that ODCTE shall not be liable to you or to any third party for any modification, suspension, or discontinuance of any part of the Site or its services.
XXIII. Survival
Any provisions of this Agreement which by their nature should survive termination shall survive the termination of your access to ctYOU.org, including, without limitation, ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.
XXIV. Feedback
Any feedback, comments, ideas, or suggestions you submit regarding ctYOU.org shall be deemed non-confidential and shall become the sole property of ODCTE.
ODCTE shall be free to use such feedback, comments, ideas, or suggestions without any obligation to you or any compensation.

Acceptance of Terms
By checking the box indicating "I Agree to the User Agreement" during account registration, you acknowledge that you have read, understood, and agree to be legally bound by the terms of this End User License Agreement (EULA).
In addition, by accessing or continuing to use ctYOU.org after registration, you reaffirm your acceptance of this Agreement and agree to comply with all its terms and conditions.
If you do not agree to the terms of this Agreement, you must not use or continue to use ctYOU.org.
